DESCRIPTION:Trial about requiring referendum on Zoning Ordinance 24-05 \nIt is at the Deadwood Court House  at 9 am\, however it is suggested folks arrive 15-30 minutes early.  We don’t know how long it will last\, but have guessed \nat 2 hours. \nIt used to be that in Lawrence County\, SD\, conditional use permits (CUPs) were decided on by the County Commission. In November 2024\, the Commission voted to make the Board of Adjustment in charge of CUPs. Board of Adjustments are appointed not elected and their decisions can’t be referred.  Lawrence County in the past has allowed referendum of a CUPs. \nFolks argue about the law – about whether CUPs approved by a County Commission can be referred or not.  Lawrence County in the past has allowed a referendum of a Commission’s approval of a CUP allowing a sand/gravel mine. \nHowever approving an ordinance is a legislative decision and should be referable. Folks collected enough signatures to refer Zoning Ordinance 24-05\, but the County refuses to allow referral. \nSo petition circulators hired attorneys  They are asking for a writ of Mandamus to force County to allow the referendum.  The attorney’s cost $200-$250 per hour. A Lawrence County non-profit\, “Save Centennial Valley”\, has agreed to accept donations to pay for the attorneys. \nPHAS endorses this effort.
