TWO ADVERSE BILLS MOVING IN FEDERAL CONGRESS“Air Permitting Improvements to Protect National Security Act.” H.R. 6373 This is legislation, which we expect would be marked up in an U.S. House Energy and Commerce subcommittee the week of December 8th-12th, would create new loopholes in the Clean Air Act to allow the President to exempt new mining, mineral processing and refining facilities, semiconductor fabrication plants, and other large polluters from vital pollution control requirements. President Trump has already exempted dozens of polluting facilities from air pollution standards using existing provisions in the Clean Air Act (see e.g. Trump Gave OK for 68 Coal Plants to Ignore Clean Air Act Standards via Email).There is no reason to give him even more tools to gut public health protections and rush approvals for mines and other polluting facilities, especially given the complete lack of environmental standards in the 1872 mining law.
